My Water Moments - Pulau Redang family holiday

Hi grandchildren,

Had a wonderful family holiday at Pulau Redang? I am sure you must have enjoyed yourself especially Lincoln who starred on stage with the Tequila Sunrise band at the Laguna Redang Island Resort (see video).

Well, how about grandpa? See the above photo? That was the boat that was to take grandpa to the Pulau Redang Marine Park and would have been the beginning of My Happy Water Moments had I known about this almost indestructible Sony TX5. But take a look at the second photo below:

The photo above represent an unfortunate Sad Water Moments for grandpa and also a death sentence for my Nikon Coolpix L22 digital camera. For unfortunately grandpa has forgotten about the camera tucked into the pouch in the waist and as grandpa waded into shoulder deep seawater, the corrosive seawater seeped into its vital organs and murdered it.

So what would be different if I had heard about this water-proof, shock-proof, temperature-proof and dust-proof Sony TX5. Well, for one thing, my camera will still be alive and grandpa would have many Happy Water Moments for the Sony TX5 is intrinsically water-proof without having to buy another waterproof casing plus it would have been WATERPROOF ALL THE TIME so no need to worry about this forgetful grandpa.

Imagine! At US$246.95 at current conversion rate that would come up to MR797.02, almost MR800! Add in the RM450 for that Nikon camera and it would have come up to MR1,250! Add in a little bit more and I could have that cool Sony TX5 waterproof camera with so many cool features which recommended retail price is RM1500. With luck and discount, perhaps it may even be less than RM1250! Then your grandpa will be in Shangri-la (like heaven). No more worries for another Sad Water Moments for then that Sony TX5 would be waterproof ALL THE TIME and not only when I add on that bulky clumsy and expensive waterproof casing. So forget full or not, that waterproof TX5 will be safe.

You know how difficult it is to capture nice photos of you very fast moving grandchildren. Photos often ended up blur because of your quick motions. Hurray, Sony TX5 comes to the rescue with that Anti-motion Blur mode to help grandpa capture those wonderful moments.

Also, by the time grandpa click that button, that rare moment that grandpa wants to capture is gone. For example, remember Lewis's 2nd birthday party? See the photo below. Grandpa managed to capture your funny smile but unfortunately Lincoln turned his head away. :-(

Grandpa latest investment protected in perpetuity

Hi grandchildren,

Your grandpa last month "invested" in your grandpa's ultimate real estate, that is, my final resting home at the Nilai Memorial Park (Location map, Nilai Memorail Park. Today, your grandpa heard some good news. Your grandpa's latest "investment" a piece of land for my last home is going to be protected by CCM (Companies Commission of Malaysia) or in Malay, SSM (Suruhanjaya Syarikat Malaysia).

The Malaysian Insider reported that buyers of burial plots and related from Protection for buyers of burial lots and niches. Apparently NV Multi Corporation Bhd and 10 of its subsidiaries must now register their business prospectus as well as their approved trustees. I have written to Nilai Memorial Park from whom I have bought my burial plot, so let's hope they respond positively and I can "rest in peace". In the meantime, read what Malaysian Insider wrote about it:

PUTRAJAYA, June 8 — Purchasers of burial lots and urn compartments in memorial parks can heave a sigh of relief as they are now protected from losing their investment should the company go into liquidation or if the land is transferred to another party.

The Federal Court, in a landmark ruling today, declared that NV Multi Corporation Bhd and 10 of its subsidiaries must register their business prospectus and the companies’ approved trustees with the Companies Commission of Malaysia (CCM) to enable the body to regulate the companies’ activities and to safeguard the public from losing their investment.

NV Multi Corporation is the operator of the Nirvana Memorial Parks which deal with cemetery development by providing services to the public to acquire burial lots and compartments for storage of urns containing ashes of the cremated, on land developed by the company as memorial parks.

A purchaser is required to execute a standard form of contract when acquiring a burial lot or an urn compartment in these parks.

Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum, who led a three-man Bench, held that this was because the company’s business fell within the definition of “interest” in section 84 (1) of the Companies Act 1965.

“Interest” is defined in section 84 (1) of the Act as any profit and asset of any financial or business undertaking or scheme or in any common enterprise in which the holder of the right or interest is led to expect profits or interest from the efforts of the promoter of the enterprise.

A company, whose business falls under that section, would be committing an offence and can be subjected to penalties of up to five years’ imprisonment and a fine of up to RM100,000 under section 94 of the Act if it fails to comply with the requirements of that section.

Malanjum, who presided together with Federal Court judges Datuk Hashim Yusoff and Tan Sri James Foong Cheng Yuen, in a 2-1 majority, dismissed the appeal brought by NV Multi Corporation, NV Alliance Sdn Bhd, Nirvana Memorial Park Sdn Bhd, Nirvana Memorial Park (Johor) Sdn Bhd, Nirvana Memorial Park (Kuching) Sdn Bhd, Nirvana Memorial Park (Klang) Sdn Bhd, NV Multi Resources Sdn Bhd, Asia Premier Propartners Sdn Bhd, Nirvana Memorial Park (Sabah) Sdn Bhd, Nirvana Memorial Park (Shah Alam) Sdn Bhd and Nirvana Memorial Park (Sibu) Sdn Bhd.

The court also ordered the companies to pay RM50,000 in costs.

Foong, in his judgment, said the company’s business fell within the definition of “interest” under section 84 (1) because both the companies and their purchasers participated in a common enterprise which involved the use of land in perpetuity and purchasers continuing to pay upkeep and maintenance costs.

In a dissenting judgment, Hashim said NV Multi Corporation’s business was basically a simple sale of burial plots and urn compartments and not an investment per se.

“There is no relationship between the purchasers of the burial plots and urn compartments among themselves and no common enterprise to re-sell their plots and urn compartments collectively. There is no sharing of profits,” Hashim said.

In 2005, the High Court ruled that the companies need not register their prospectus with CCM and also their trustees after the latter (the companies) obtained a declaration that their business in relation to the sales of urn compartments and burial lots did not fall under the definition of “interest” in that section of the Act.

However, in 2008, the Court of Appeal reversed the High Court’s decision after allowing CCM’s appeal. — Bernama
